Privacy Policy for Wellbeing Telehealth


This Privacy Policy describes the policies and procedures of Oculum, Inc., and its affiliates and subsidiaries (“we”, “our” or “us”) on information that is collected from you when you visit wellbeing.oculumvc.com (the “Site”) and access the services, features, content, or applications we offer for Wellbeing Telehealth (collectively with the Site, the “Services”) and how we may use and disclose that information.


  • We do not collect information other than what is needed to operate the Services.

  • We do not store any patient associated information, other than phone numbers used to establish a session if specifically requested by the healthcare provider.

  • We do not record or store the audio/video information for a session and each session is encrypted.

  • We do not directly collect or process Protected Health Information (PHI).



For Patients:


When you click on an invitation link sent from our servers on behalf of your healthcare provider, your device will connect to a waiting room associated with your healthcare provider. You do not need to register with us in order to receive or accept an invitation. You may enter any name you choose for the waiting room when prompted for a name. We do not monitor or verify your name.


Until the session is ended by you or your healthcare provider, we retain your device’s current IP address and the name you entered for the waiting room. Once the session is ended, we do not store or otherwise retain the name you enter or the IP address, nor do we associate your name or IP address with the email address or phone number provided by your healthcare doctor for the invitation.


We may store the phone number used for the SMS (text) invitation message if specifically requested by your healthcare provider. We may provide your phone number to your healthcare provider in a log file with other phone numbers associated with your healthcare provider, but we do not sell your phone number or use your phone number for advertising. We may also retain the length of time for your session. You may end the session at any time.


All audio/video communications for your session are encrypted. We do not monitor or record the communications. This means that any information, including Protected Health Information (PHI), that you share with your healthcare provider via the audio/video session, including screenshares and chats, is encrypted.


You may invite others to participate in a session. We do not monitor, nor are we responsible for such invitations, and you acknowledge that anyone you invite may access any information that is exchanged in the session, including your PHI.


Note: Certain functions, such as screensharing, may reveal information that you do not intend to be seen to any others in the session. Please ensure that you only use such functions when you are sure that you are comfortable revealing any viewable information with other session participants.



For Healthcare Providers:


You must register as an individual for an account on the Site in order to access the Services. In establishing an account, we may collect personal information from you, including:


  • Your name;

  • Your contact information, including your phone number and email address; and

  • Your clinic’s name and contact information


You agree that we may use your submitted information to confirm with the identified clinic and/or another entity that you are an authorized member before providing you with access to the Services if we have an arrangement with the clinic or other entity.


When you send an invitation link from our server to your patient, the link will associate the patient with your waiting room. Your patient may enter any name they choose, and we do not monitor or verify your patient’s name. You are responsible for ensuring the person entering the session is your patient, and that consent has been obtained as may be required.


We may store your IP address and may associate it with your waiting room and your personal information in order to provide the Services to you, including notifying you when a patient is waiting. We may also use this information to improve the Services.


All audio/video communications for each session are encrypted. We do not monitor or record the communications. This means that any information, including Protected Health Information (PHI), that you share with your patient via the audio/video session, including screenshares and chats, is encrypted. A file that you send to your patient is forwarded via our secure server and the temporary file is deleted from our server as soon as the file is transferred to your patient.


You may invite others, in addition to your patient, to participate in a session. We do not monitor, nor are we responsible for such invitations, and you acknowledge that anyone you invite may access any information that is exchanged in the session, including personal information and PHI. It is your responsibility to ensure that anyone invited to a session is legally entitled to access the information.


Note: Certain functions, such as screensharing, may reveal information that you do not intend to be seen to any others in the session. Please ensure that you only use such functions when you are sure that you are comfortable revealing any viewable information with other session participants.


The Services and our products are intended only for individuals who are at least 18 years old. We do not monitor or otherwise identify the participants in a session, and rely on you to ensure that participants are at least 18 years of age.


General:


1. Children under 13


The Services and Site are intended only for individuals who are at least 18 years old. We do not knowingly collect personal information from children under 13. If we learn that we have collected any personal information from a child under the age of 13 without verifiable parental consent, we will delete that information from our database and terminate any corresponding account. If you believe that we may have collected information from a child under 13, please contact us at legal@oculumvc.com.


2. Visitors from outside the United States


The Services and Site are currently intended only for residents of the United States of America. If you visit the Site from another country, please be aware that information you provide to us or that we obtain as a result of your use of the Site may be processed in and transferred to the United States and will be subject to U.S. law. U.S. privacy and data protection laws may not be equivalent to the laws in your country of residence. By using the Site or providing us with your information, you consent to the collection, transfer, storage, and processing of information to and in the United States.


3. Changes to the Privacy Policy:


We may amend this Privacy Policy from time to time. The most current version of the Privacy Policy will govern our use of your information. If we make a change to the Privacy Policy that, in our sole discretion, is material, we will notify you by posting an announcement on the Services or sending an email to the email address associated with your account. By continuing to access or use the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.
